Terms of Service

By accessing or using iSmartSociety's platform, website, or mobile applications (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.

If you are using the Services on behalf of a society, housing cooperative, or organisation, you represent that you have the authority to bind that entity to these Terms.

If you do not agree to these Terms, you may not access or use our Services. We reserve the right to modify these Terms at any time with appropriate notice to users.

iSmartSociety provides a multi-platform society management solution consisting of:

Our Services are provided as a Software as a Service (SaaS) platform under a subscription model. Features available to you depend on your subscription plan (Trial or Paid) and the permissions granted by your Society Administrator.

**Registration:** To use iSmartSociety, you must register with a valid mobile number and complete OTP verification. You agree to provide accurate, current, and complete information.

**Account security:** You are responsible for maintaining the security of your account. A user account may only be active on one device at a time — logging in on a new device will automatically log out the previous session.

**Society join requests:** Membership in a society community is subject to approval by the Society Administrator. iSmartSociety is not responsible for the approval or rejection of join requests.

**Account termination:** We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or are inactive for extended periods.

You agree to use iSmartSociety only for lawful purposes and in accordance with these Terms. You must not:

**Your content:** You retain ownership of content you create and share on iSmartSociety (notices, images, messages, etc.). By posting content, you grant iSmartSociety a non-exclusive, royalty-free license to use, display, and transmit that content solely to operate and provide the Services.

**Content standards:** Content must not be illegal, offensive, discriminatory, or violate any third-party intellectual property rights.

**Content moderation:** Society Administrators are responsible for managing content within their society. iSmartSociety may remove content that violates these Terms.

**Data responsibility:** Society Administrators are responsible for the accuracy and legality of member data, billing records, and other society-specific information entered into the platform.

**Plans:** iSmartSociety offers a Free Trial plan and Paid subscription plans priced per house per month. Plan details are available at www.ismartsociety.in/pricing.

**Trial period:** The Free Trial provides access to all core features for the trial duration. No credit card is required to start a trial.

**Paid plans:** Subscription fees are billed in advance for the selected billing period (monthly or yearly). All fees are exclusive of applicable taxes.

**Upgrade during trial:** If a Paid plan is purchased during a Trial period, the Paid plan activates after the Trial period expires.

**Non-payment:** Failure to pay subscription fees may result in service suspension. We provide at least 7 days' notice before suspending services due to non-payment.

**Refunds:** Subscription fees are non-refundable except as required by applicable law. Contact billing@ismartsociety.in for billing disputes.

All rights, title, and interest in the iSmartSociety platform, software, design, and content (excluding your content) remain the exclusive property of iSmartSociety and its licensors.

You may not copy, reproduce, distribute, modify, or create derivative works from our platform, software, or content without prior written consent.

The iSmartSociety name, logo, and tagline "Powering Smarter Community Governance" are trademarks of iSmartSociety and may not be used without permission.

Your use of iSmartSociety is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you agree to the collection and use of your information as described in the Privacy Policy.

**Service availability:** We target 99.5% uptime but do not guarantee uninterrupted access to the Services. We are not liable for downtime caused by force majeure, third-party service failures, or scheduled maintenance.

**Accuracy:** iSmartSociety provides tools to manage society data. We are not responsible for inaccuracies in member-entered data, billing records, or communications.

**Limitation of liability:** To the maximum extent permitted by law, iSmartSociety shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our total liability shall not exceed the fees paid by you in the 3 months preceding the claim.

**Third-party integrations:** We are not responsible for the terms or privacy practices of third-party services integrated with our platform (Google Maps, Firebase, Razorpay, etc.).

**By you:** You may terminate your account at any time by contacting support@ismartsociety.in. Society Administrators may request full data export before account closure.

**By iSmartSociety:** We may suspend or terminate your access for violation of these Terms, non-payment, fraudulent activity, or at our discretion with 30 days' notice (except for violations requiring immediate action).

**Effect of termination:** Upon termination, your right to use the Services ceases. Your data is retained for 90 days post-termination before permanent deletion, in accordance with our Privacy Policy.

These Terms are governed by the laws of India. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in Ahmedabad, Gujarat, India.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
